Privacy Policy

Introduction

Matt Hammond Inc. d/b/a AeroPoint ("AeroPoint") respects your privacy and is committed to protecting it by complying with this Privacy Policy (the "Policy").

This Policy describes the types of information AeroPoint may collect from you or that you may provide when you visit the website AeroPoint.com (the "Site") or otherwise engage with any content, functionality, services, or other online experiences offered under the AeroPoint trade name or otherwise on or through the Site (collectively with the Site, the "Service"), as well as our practices for collecting, using, maintaining, protecting, and disclosing that information. This Policy is an integral part of our End User Terms of Service, located at https://aeropoint.com/legal/eula (the "EULA"), which govern your use of and access to the Service. When completing the initial registration process for your user account, you agree to be bound by the EULA, including this Policy. Any capitalized term used, but not defined, in this Policy has the definition given to such term in the EULA

This Policy applies to information about Users that AeroPoint collects, processes, or generates:

  • on or through the Service;
  • from or on behalf of Customers in relation to the Service;
  • in email, text, and other electronic messages between you and the Service; and/or
  • through mobile and desktop applications you download from the Site or through the Apple App Store, which provide dedicated non-browser-based interaction between you and the Service.

It does not apply to information:

  • collected by AeroPoint offline or through any other means, including on any other website operated by Matt Hammond Inc. or any third party;
  • maintained, collected, or processed by any Customer, except to the extent such information is provided to AeroPoint as described in this Policy;
  • disclosed to any portion of the Site that can be viewed by the public (or by other Users generally), or information disclosed directly to another User; or
  • maintained, collected, or processed by any third party, including through any application or content that may link to or be accessible from or on the Site.

Please read this Policy carefully to understand our policies and practices regarding your information and how AeroPoint will treat it. If you do not agree with our policies and practices, your choice is to not use our Service in any capacity. By accepting the EULA and accessing or using any part of the Service, you agree to this privacy Policy. This Policy may change from time to time (see "Changes to Our Privacy Policy" below) without notice to you (except to the extent required by law). Unless additional steps are required by applicable law or otherwise described in this Policy, your continued use of the Service after AeroPoint makes such changes is deemed to be your acceptance of those changes, so please check the Policy periodically for updates.

Children Under the Age of 16

The Service is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Service. AeroPoint does not knowingly collect Personal Information from children under 16. If you are under 16, do not use or provide any information on this Site, on the Service, or through any of their respective features, register on the Service, make any purchases through the Site, use any interactive or public comment features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If AeroPoint learns that AeroPoint has collected or received Personal Information from a child under 16 without verification of parental consent, AeroPoint will delete that information. If you believe AeroPoint might have any information from or about a child under 16, please contact us at info@aeropoint.com.

Information AeroPoint Collects About You and How AeroPoint Collects It

AeroPoint collects several types of information from and about Users, including information:

  • by which you may be personally identified, such as your name, e-mail address, telephone number, and the name of the company with which you are affiliated ("Personal Information");
  • about your internet connection, the equipment you use to access the Service, and usage details.

AeroPoint collect this information:

  • directly from you when you provide it to us, such as when you or a Customer provide registration information for a User account, when you submit flight detail information, or when you report a problem with the Service and receive support;
  • from Customers, such as when a Customer provides information to verify your affiliation with the Customer;
  • automatically as you navigate through the Service, including through cookies;
  • from third parties, for example, our business partners or services that integrate with the Service.

Information AeroPoint Collects Through Automatic Data Collection Technologies

As you navigate through and interact with the Service, AeroPoint may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • details of your visits to our Site and use of the Service, including traffic data, logs, and other communication data and the resources that you access and use on the Service; and
  • information about your computer, mobile device, and internet connection, including your IP address, operating system, and browser type.

AeroPoint may use cookies or browser cookies to collect this information. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain features of the Service. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Site or utilize the Service.

Third-Party Links and Third-Party Collection of Cookies and Other Tracking Technologies

We may provide links to third party sources such as websites, applications, content or software. When you use a link online to visit such third parties, you will be subject to their privacy policy and the jurisdiction of governing law selected by such third party.

Additionally, some content or applications provided on the Site are served by third-parties, including content providers and application providers. These third parties may use cookies to collect information about you when you access the Site. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different sites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

AeroPoint does not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content you receive on a third party's site, you should contact the responsible provider directly. AeroPoint does not show advertisements to users on the Service.

How AeroPoint Uses Your Information

Without obtaining additional authorization from you or your authorized representative, AeroPoint may use information that we collect about you or that you provide to us, including Personal Information, as described in this Policy. AeroPoint does not sell your Personal Information. AeroPoint uses information that AeroPoint collects about you or that you provide to us, including any Personal Information:

  • to present the Service and Content to you;
  • to provide you with information, products, or services that you request from us;
  • to fulfill any other purpose for which you provide it;
  • to provide you with notices about your User account and Access Credentials, including expiration and renewal notices;
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us;
  • to notify you about changes to the Services, including new features and updates;
  • to improve our Service and to develop new services or features;
  • to allow you to participate in interactive features on our Service;
  • to estimate our audience size and usage patterns and assess our position in the market;
  • to store information about your preferences;
  • to recognize you when you return to our Service or use the Service on different devices;
  • to protect our company, our affiliates, our customers, and our websites, and to comply with laws, regulations, court orders, or other legal obligations;
  • to enforce the EULA, this Policy, or agreements with third parties (including Customers), or to detect fraud or other criminal activity; and/or
  • in any other way AeroPoint may describe when you provide the information.

Disclosure of Your Information

Without obtaining additional authorization from you or your authorized representative, AeroPoint may disclose information that we collect about you or that you provide to us, including Personal Information, as described in this Policy. Permitted disclosures of information include disclosures:

  • to the Customer which is linked to your use of our Service;
  • to our subsidiaries and affiliates;
  • to contractors, service providers, and other third parties AeroPoint uses to support our business;
  • third parties to whom you, or an authorized agent on your behalf, authorized us to disclose your Personal Information;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our Users is among the assets transferred;
  • to fulfill the purpose for which you provide it;
  • to enforce or apply the EULA, this Policy, or agreements with third parties (including Customers), including for billing and collection purposes;
  • to comply with any court order, law, or legal process, including to respond to any law enforcement, government or regulatory request, including in connection with public health activities;
  • to any other purpose disclosed by us when you provide the information; and/or
  • if AeroPoint believe disclosure is necessary or appropriate to protect the rights, property, or safety of Matt Hammond Inc., our customers, or others.

You may choose to share information through our Service with other Users or the public when you post content or otherwise provide information about yourself. This includes information entered into the Deconfliction Service. We are not responsible for use of the available information by other Users or the public, so you should carefully consider whether and what to post or how you identify yourself.

Any use or disclosure of your Personal Data not listed in this Policy will be made only with your authorization unless we are permitted by applicable law to make such other use and disclosure, in which case we shall comply with applicable law.

Choices About How AeroPoint Uses and Discloses Your Information

AeroPoint strives to provide you with choices regarding the Personal Information you provide to us. AeroPoint has created mechanisms to provide you with the following control over your information:

Access to Information

Twice per twelve (12) month period, you have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months from the date we receive your request. Once we receive and confirm your request (or a request on your behalf from an authorized agent or representative), we will disclose to you or such personal representative:

  • the categories of Personal Information we collect;
  • the categories of sources of the Personal Information we collect;
  • our business or commercial purpose for collecting such Personal Information;
  • the categories of third parties to whom we disclosed the category of Personal Information for a business or commercial purpose;
  • the business or commercial purpose for which we sold or disclosed the category of Personal Information; and
  • the specific pieces of Personal Information we collected about you in a form that you can take with you (a "Data Portability Request").

Correction of your Information

You can review and change your Personal Information by logging into the Site and visiting your account profile page.

You may also send us an email at info@aeropoint.com to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your User account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Deletion/Erasure Requests

You have the right to request that we delete any of your Personal Information that we request from you and retain, subject to certain exceptions. Once we receive and verify your request, we will delete and direct our service providers to delete your Personal Information from our records. We may deny your deletion request if an exception applies or if retaining the Personal Information is necessary for us or our service providers to:

  • complete the transaction for which we collected the Personal Information, provide a product or service you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity or prosecute those responsible for such activity;
  • debug to identify and/or repair errors that impair existing intended functionality of the Service; and/or
  • enable solely internal and lawful uses of such Personal Information that are compatible with the context in which you provided it.

The rights and choices in this section do not apply to you if the information being collected is aggregated consumer information, de-identified consumer information, or publicly available information.

Requests to Exercise Your Access, Data Portability, and Deletion Rights

To exercise your rights to access, data portability, deletion, or any other rights mentioned in this Policy, you or your authorized agent may submit a verifiable request to us by using the contact information below.

If a request is made by an authorized agent acting on your behalf, we may require (i) submission of evidence by you with your permission for the agent to submit a verifiable request on your behalf; (ii) for you to directly acknowledge, via electronic communication, that the agent is allowed to act on your behalf; (iii) request the agent to verify their identity; or (iv) request a copy of a power of attorney or similar document that is signed accordance with state law.

We cannot respond to your request or provide you with Personal Information if we cannot (i) verify your identity or authority to make the request and (ii) confirm the Personal Information is related to you. We will only use Personal Information provided via a verifiable request to verify the requestor's identity and/or authority to make the request. Making a verifiable request does not require you to create an account with us.

We will respond to any verifiable request within forty-five (45) days of its receipt. If we require more time, we will inform you in writing of the reason for the delayed response.

Your California Privacy Rights

Data Security

AeroPoint has implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls.

The safety and security of your information also depends on you. Where AeroPoint has given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. AeroPoint asks you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. If you submit Personal Information to use electronically, it may not be secure when it is transmitted to us. We recommend that you do not use unsecured or public channels to communicate sensitive or confidential information. Accordingly, although AeroPoint does our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Service. AeroPoint is not responsible for circumvention of any privacy settings or security measures contained on the Service.

Changes to Our Privacy Policy

It is our Policy to post any changes AeroPoint makes to our privacy Policy on this page with a notice that the Privacy Policy has been updated on the Site home page. If AeroPoint makes material changes to how AeroPoint treats our users' Personal Information, AeroPoint will notify you by email to the email address specified in your account. The date the Policy was last revised is identified at the top of this page. You are responsible for ensuring AeroPoint has an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Policy to check for any changes.
